Тзв. неосновани раскиди отварају низ питања, па стварају за нашу судску/арбитражну праксу доста дилема. У правним системима попут нашег, у којима се уговор због неизвршења раскида изјавом воље повериоца, мимо суда, и пред самим повериоцима је не тако лак задатак. The subject of the doctoral dissertation is the definition of the concept, as well as of consequences incurred by unfounded declaration of intention due to failure of performance. The so-called unfounded termination brings fourth a plethora of issues thus creating many a dilemma for the case/arbitration law in this country. In legal systems such as the one in this country , in which the contract, due to failure of performance, is terminated by the creditor`s declaration of intention, the so-called extra-judicial termination, the creditors are faced with by no means an easy task.
