o:28899 Sedište arbitraže u međunarodnoj trgovinskoj arbitraži Seat of arbitration in international commercial arbitration sr Abstract This contribution offers an analysis of the seat of arbitration in international commercial arbitration from the perspective of international conventions and other uniform rules relevant for arbitration, national legislations and rules of institutional arbitrations, taking into consideration the relevant case law and the views expressed in doctrine. In that respect, the paper examines three basic questions - definition and determination of the seat of arbitration, legal importance of the seat of arbitration and party agreement on the seat of arbitration. The analysis aims to offer the practical recommendations to the parties with respect to the choice of the seat of arbitration and drafting of an agreement on the seat of arbitration which precisely reflects the parties' intention on the international level.
