o:18151 Одузимање имовине учиниоцима кривичних дела Property confiscation from criminal acts perpetrators : doctoral dissertation sr Резиме: Кривична дела се често врше у циљу стицања економске користи, односно ради богаћења мимо прописаних друштвених регула. Тако стечена имовинска вредност не може бити предмет правне заштите и одувек је подлегала одузимању. Предмет ове дисертације јесте целовито истраживање инструмената кривичног права намењених одузимању криминалне имовинске вредности. У том оквиру, нарочита пажња је посвећена мери одузимања имовинске користи прибављене кривичним делом и мери одузимања имовине проистекле из кривичног дела. Такође, у вези са одузимањем криминалне имовине истражени су и други институти кривичног права (нпр. имовинскоправни захтев оштећеног), као и могућност примене појединих кривичних дела у ту сврху (нпр. прање новца). Исто тако, одређена пажња је посвећена и потенцијалима одузимања криминалне имовине изван оквира кривичног права. Истраживања у овој дисертацији су усмерена, пре свега, на домаће кривично право, па је у ту сврху употребљена и одговарајућа палета метода истраживања у правним наукама. Коришћени су нарочито догматски, нормативни, аксиолошки, лингвистички, каузално-експликативни, историјски и упоредноправни метод. Циљ овог рада је идентификовање правне природе института намењених одузимању имовине криминалног порекла, њихово систематизовање и повезивање у могуће шире целине према сродности, те анализа позитивноправних решења у погледу домашаја, предности и недостатака de lege lata, са теоријским образлагањем. Summary: Criminal acts are often perpetrated with the aim of material gain, in other words to get wealth with no respect for proposed social regulations. Such material gain cannot be legally protected and has always been the possible subject of confiscation. The topic of this dissertation is the entire research of the instruments of the Criminal Law dedicated to confiscation of material gain obtained from criminal acts. In this framework a special attention has been paid to the measure of confiscating material gain obtained from criminal offence and the measure of confiscating the property derived from criminal activity. Furthermore, relating to confiscation of material gain obtained from criminality, other institutes of Criminal Law have been explored (for example a property claim of the injured party), as well as the possibility of applying certain criminal offenses for this purpose (money laundering for example). Also, a certain attention has been paid to potentials of confiscation of material gain obtained by criminality outside the framework of Criminal Law. Researches in this dissertation aim, above all, at domestic Criminal Law, so suitable variety of research methods in legal sciences has been used for this purpose. Dogmatic, normative, axiological, linguistic, cause-explicative, historical methods and methods relating to comparative law research have been particularly used. The purpose of this work is identifying the legal nature of the institutes aimed at confiscation of assets of criminal origin, their systematization and interconnection into possible wider totals according to their correlation, and analysis of solutions coming out of the positive legislation concerning the reach, pros and cons de lege lata, with theoretical presentation.
