The primary difference between common-law opinions and fatwas, however, is that fatwas are not universally binding; as the Sharia is not universally consistent and Islam is very non-hierarchical in structure, fatwas do not carry the sort of weight that secular common-law opinions do.

    <ns1:description language="sr">U fetvama se, opšte uzev, nalaze detalji kako razmišlja znalac islamskog prava, obično u znak odgovora na neki poseban slučaj, i oni muslimani, uključujući i buduće muftije, koji su povezani sa tim znalcem smatraju ih obavezujućim presedanom; sama pravila se mogu uporediti sa zabeleženim mišljenjima. Najvažnija razlika između mišljenja u skladu sa opštim pravom i fetvama ipak jeste u tome što fetve nisu uopšteno obavezujuće; pošto šerijat nije univerzalno dosledan i u islamu ne postoji hijararhijska struktura, fetvene nose takvu težinu koju imaju mišljenja iz svetovnog opštog prava.
